3. Collection and Processing of Personal Data
When you visit our website, technical data is automatically collected and transmitted by your browser to our server. This includes IP address, browser type and version, operating system, referrer URL, hostname, date and time of the request, and the volume of data transferred. This data is stored in server log files and used exclusively to ensure technical operation, identify errors and optimise the website.
If you contact us by email or telephone, we process the information you provide (name, contact details, content of your enquiry) in order to respond to your request and handle any follow-up questions.
Applications are usually submitted via the application form on the platform Join (Join Solutions AG, Berlin, Germany), which we use as a recruiting tool. Your application data is entered directly on the Join platform, which processes it on our behalf. The privacy policy of Join also applies on the platform itself. Incoming applications are treated confidentially and used exclusively to assess your application. After the recruitment process is concluded, the documents are deleted unless you have expressly agreed to longer retention. Applications by email are also possible.
4. Purposes of Data Processing
We process personal data primarily to ensure the operation and security of our website and to communicate with prospective clients, clients and business partners. This includes handling enquiries, managing applications and sending the newsletter to people who have subscribed. We also process personal data to comply with legal obligations and to safeguard legitimate interests, in particular to improve our services and to assert legal claims.
5. Legal Basis
Where the revFADP applies, we generally do not require a specific legal basis to process your personal data, provided we comply with the statutory principles. Where the GDPR applies, processing is based, depending on the situation, on your consent (Art. 6 para. 1 lit. a GDPR), on the initiation or performance of a contract (Art. 6 para. 1 lit. b GDPR), on the fulfilment of legal obligations (Art. 6 para. 1 lit. c GDPR) or on legitimate interests of ours or of third parties (Art. 6 para. 1 lit. f GDPR).
6. Retention Period
We process and store your personal data only for as long as is necessary to fulfil the relevant purpose or as required by statutory retention obligations, such as the ten-year retention obligation for business records under Art. 958f of the Swiss Code of Obligations. Thereafter, the data is deleted or anonymised.
7. Disclosure of Data and Transfer Abroad
We disclose personal data only where this is necessary for the stated purposes, where required by law or where you have consented. Recipients are in particular processors providing services on our behalf, such as hosting, newsletter distribution or web analytics, as well as authorities, where we are legally required to do so, and advisors such as lawyers, trustees or auditors.
We use external service providers whose servers may also be located in countries outside Switzerland and the EU, in particular in the USA. Specifically, we use Webflow Inc. (USA) for hosting the website, Intuit Mailchimp (USA) for newsletter distribution, Google Ireland Ltd. and Google LLC (Ireland and USA) for web analytics with Google Analytics, and Join Solutions AG (Germany) as the recruiting platform for applications.
Where personal data is transferred to countries that do not provide an adequate level of data protection under Swiss law, we base such transfers on the EU Standard Contractual Clauses (SCC) in combination with supplementary measures, on the EU-U.S. or Swiss-U.S. Data Privacy Framework, or on other permissible legal grounds.
8. Your Rights
Within the scope of the applicable law, you have the right to access the personal data we process about you, to have inaccurate data corrected, to have your data deleted and to restrict the processing of your data. You may also request the release or transfer of your data in a common electronic format, object to processing in certain cases and withdraw any consent you have given at any time with effect for the future.
To exercise these rights, please contact info@oppenheim.agency. You also have the right to lodge a complaint with the competent data protection authority. In Switzerland, this is the Federal Data Protection and Information Commissioner (FDPIC); in the EU, it is the relevant national supervisory authority at your place of residence.
9. Data Security
Our website uses SSL or TLS encryption. You can recognise an encrypted connection by the "https://" prefix in the address bar and the padlock symbol in your browser. We take appropriate technical and organisational measures to protect your data against loss, misuse and unauthorised access. However, complete protection of data transmitted over the internet cannot be guaranteed.
10. Cookies and Web Analytics
10.1 Cookies
Our website uses cookies. Cookies are small text files stored on your device that support the smooth operation of the website and the analysis of its use. You can decide in your browser settings whether and how cookies are stored. If cookies are deactivated, some functions of the website may not be fully available.
10.2 Google Analytics 4
We use Google Analytics 4 (GA4), a web analytics service provided by Google Ireland Ltd. (Gordon House, Barrow Street, Dublin 4, Ireland) and Google LLC (Mountain View, CA, USA). GA4 processes usage data such as pages visited, time spent, device information and shortened IP addresses to provide statistical analyses of website use. These analyses help us improve our offering.
In connection with GA4, data is transferred to Google servers in the USA. Google is certified under the EU-U.S. and Swiss-U.S. Data Privacy Framework. Further information on data protection at Google Analytics can be found at https://policies.google.com/privacy and at https://support.google.com/analytics/answer/6004245.
11. Newsletter
You can subscribe to our newsletter on our website. For distribution, we use the service Mailchimp provided by Intuit Inc. (USA). Upon subscription, we collect your email address and the date and time of registration. Subscription follows the double opt-in procedure, meaning that after entering your email address you receive a confirmation email containing a link that you must actively click.
Processing is based on your consent. You can unsubscribe from the newsletter at any time, either via the unsubscribe link in each newsletter or by sending a message to info@oppenheim.agency. The lawfulness of any processing carried out before the withdrawal of consent remains unaffected.
Mailchimp performs statistical analyses of user behaviour in newsletters, such as open and click rates. These analyses help us improve the newsletter and tailor its content. Further information can be found in the Mailchimp privacy policy at https://www.intuit.com/privacy/statement.
12. Links and Social Media
On our website you will find links to our profiles on LinkedIn and Instagram. When you click on them, you will be redirected to the respective platform. Personal data is only collected by the respective platform once you arrive there, in accordance with its own privacy provisions. We have no influence on this data processing. The respective provider or operator is responsible for the content of any external pages linked from our website.
13. Changes to This Privacy Policy
We reserve the right to amend this privacy policy at any time to reflect changes in the law or in our services. The version published on this website at the relevant time shall apply.
